The National Beer Wholesalers Association (NBWA) applauds the recent decision of the Supreme Court of the United States to deny certiorari on the appeal of Brooks v. Vassar from the Fourth Circuit Court of Appeal. NBWA believes that action demonstrates that the U.S. Supreme Court affirms the importance of the 21st Amendment and the value of state-based regulation for alcohol beverages.
Many states are reevaluating the antiquated blue laws that outlaw alcohol sales on Sundays. Allowing retail sales of alcohol on Sundays would not only increase customer convenience and improve the bottom line of the small businesses doing the selling, but would also produce extra tax revenue without having to increase taxes.
Alcohol tax increases have been proposed in at least 36 states this year despite the fact 42 states have budget surpluses. More than half of these attacks on the hospitality industry are supported by anti-alcohol organizations and cloaked in rhetoric about the need to fund social programs that treat problems caused by alcohol abuse.

Specialty Beer Company." Walter will lead the new Labatt USA organization, which
will focus on selling and marketing all Labatt brands and Brahma in the United
States following the recently announced agreement with Anheuser-Busch for the
sales and distribution of InBev's European brands in the United
States.
Pernod Ricard USA announced that
Patrick Piana has been named senior vice president, spirits marketing for the
company. Piana joins Pernod Ricard USA from Moët Hennessy USA, where he served
as a senior vice president. He will be charged with driving breakthrough
marketing for Pernod Ricard USA's expanded portfolio of premium and
super-premium spirits and category leaders, including Chivas Regal, Martell,
Kahlúa, Malibu, Stoli, Beefeater, The Glenlivet and Jameson, among others.
Pennsylvania Liquor Control Board Gets a New Chairman
Wednesday,
January 3, Pennsylvania Governor Ed Rendell appointed PJ Stapleton as Chairman
of the Pennsylvania Liquor Control Board (PLCB), following the resignation of
Chairman Jonathan Newman. Newman resigned, effective January 12, after serving
as PLCB chairman the past 4 1/2 years. In recent remarks, he has been highly
critical of Rendell's creation of a PLCB CEO position, to which the Governor
then appointed former state Senator Joe Conti. In his letter of resignation,
Newman took issue with the lack of process in the creation of the position and
the appointment. Before Mr. Stapleton can assume the responsibility of
Chairman, he must first be confirmed by the Pennsylvania State Senate. Mr.
Stapleton has served on the PLCB since 1997.

international. In this newly created position, Walter will manage the company's

Wyoming.

Typo in New York Legistlation Sets Unreasonably Low Limit in Drunk Driving Law
It recently has come to light that a typo in a piece of New York legislation
passed this year has set the standard for "misdemeanor aggravated driving while
intoxicated" level at .18 grams of alcohol in an individual's blood, rather than
the intended .18 BAC (percentage of blood alcohol content). According to
Rochester DWI lawyer Ed Fiandach, this standard is so low that the alcohol
naturally in one's body could potentially exceed this limit.
New Liquor Control Board Chair Appointed in Washington
On October 30, the Washington Liquor Control Board announced Governor Christine
Gregoire's appointment of Ms. Lorraine Lee as the new Chair of WLCB. Lee fills
the post formerly held by Merritt Long. She will take office on November 16,
2006.
As an industry, beverage alcohol always seems to be a target for tax increases.
Year after year, dozens of state officials attempt to increase taxes on spirits,
beer and wine - in spite of beverage alcohol's importance to the hospitality
industry. It is unlikely that 2007 will be any different.
